Elaine Cyphers, the Human Resources Manager of Toshiba America Nuclear Energy (TANE) Corporation, recently filed a class action lawsuit in New York alleging gender discrimination against herself and other female employees of TANE and its parent corporation, Toshiba America, Inc.
Elaine Cyphers was hired by TANE in June 2008 to be its Human Resources Manager. Prior to coming to TANE, Ms. Cyphers had human resources experience for more than 20 years. The Complaint alleges that Toshiba violated the requirements of the Fair Labor Standards Act, the Civil Rights Act and the Equal Pay Act in its treatment of her and its other female employees.
The complaint also alleges that Toshiba retaliated against Ms. Cyphers when she reported discriminatory conduct to the company’s General Counsel involving Toshiba’s Vice President of Human Resources. It is alleged that after Ms. Cyphers interviewed for and was given the highest Human Resources job at TANE, the company created a new HR position superior to Ms. Cyphers position which it did not publicize or notify Ms. Cyphers about. TANE allegedly gave the job to a male employee from within the company who was less qualified and less experienced than Ms. Cypers. Subsequently, Ms. Cypers’ primary duties as Human Resources Manager were taken away and she was given lower level job duties. Also, her duties for recruiting and hiring were taken away and given to a less qualified and less experienced male contract employee.
Ms. Cypers is seeking declaratory and injunctive relief, back pay, front pay, and lost benefits as well as compensatory, nominal, and punitive damages in an amount of $100 million or more for herself and similarly situated female Toshiba employees across the U.S.
