Girl Walking Bicycle Across Princess Anne Road Hit By Car Seriously Injured

On Saturday, May 11 a fourteen year old girl was hit by a vehicle as she attempted to walk her bicycle across Princess Anne Road and Matthews Green Road in Virginia Beach. The accident happened around 3:30 p.m.

As the victim and her friend attempted to cross the road one vehicle stopped for them, but another did not stop hitting the girl and throwing her 35-40 feet. According to WTKR, the victim was reported to have been seriously injured and losing consciousness at one point.

It has now been reported that she was released from the hospital on Monday and is expected to recover, according to the Virginian Pilot.

The driver, Brian Michael Montella has been charged with driving without a license.

2 Bicyclists Seriously Injured by Tractor-Trailer in Charles City Co Hit & Run

On Saturday, May 11 a tractor-trailer traveling down Route 160 in Charles City County struck two bicyclists and continued driving.

According to NBC12, shortly after 11:30 a.m. the driver of the tractor-trailer attempted to pass a group of bicyclists crossing the double solid line. To avoid hitting a Ford F-150 head on, the tractor-trailer was forced to swerve back into his lane striking the two bicyclists. The tractor-trailer did not stop at the scene.

Jonathan Clark of North Carolina and Will Bagby of Richmond were flown to VCU Medical Center with serious injuries. Jonathan Clark was in surgery for eight hours on Saturday.

Fatal Crash at Elbow Road & Centerville Turnpike in Chesapeake

A fatal car crash occurred on Elbow Road and Centerville Turnpike around 7:30 a.m when two cars collided. Robert Edward Rosendahl of Chesapeake was killed in the accident. According to WAVY, the driver of the other vehicle was taken to the hospital with non-life threatening injuries.

Elbow Road is a narrow two-lane road with no shoulders that connects Chesapeake to Virginia Beach. The speed limit is 45 MPH, and according to nearby residents is a place of frequent devastating collisions.

In an interview with NewsChannel3 Christina Bodnar, who lives nearby, told them, "There have been several mornings since we've lived here that we've gotten up, and there’s been in accident in the same place, always in the same place for the last three years or so."

The City of Chesapeake has recognized the dangers on this road and have been planning a project to widen two of its curves, however the project won't be ready to start until 2014.

Fatal Chesterfield Route 150 Wrong Way Head On Collision

According to WTVR, around 1:44 a.m. on Saturday a woman driving a 1991 Buick the wrong way down Chippenham Parkway (Route 150) in Chesterfield County was killed after hitting another car head on.

The woman driving the Buick traveling the wrong way was 70-year-old Drema McCauley. Sadly, Drema McCauley was killed after she hit a Nissan Altima head-on. A passenger in the Buick sustained minor injuries while the driver of the Nissan Altima, suffered serious injuries.

Motorcycle Accident Deaths Increased in 2012; 5000+ Lives Lost

In 2012 motorcyclist deaths increased by about 9% accounting for more than 5,000 deaths, according to a preliminary report released by the Governors Highway Safety Association (GHSA). This is reported to be an all time high, and motorcyclists appear to be the only roadway user group that has digressed over the last ten years.

The report indicates that the data defines a motorcyclist as "any person operating or riding as a passenger on a motorcycle, motor scooter, or other two-wheeled motorized vehicle."

Several factors such as weather, the economy, and gas prices were listed as reasons for this increase.

Multi-Vehicle Motorcycle Accident on I-95 Near Quantico w/ Serious Injuries

A serious 6 car accident including a motorcycle occurred this morning around 5:45 a.m. on Interstate 95 in Stafford Exit 148 Quantico.

The driver of a Chrysler station wagon, Sandra T. Wilson, failed to slow down and stop for traffic crashing into the back of a 2012 Honda. A motorcycle then rear-ended the Chrysler, slid into another lane throwing the motorcyclist of his bike. The motorcyclist was then hit by a tractor-trailer.

To avoid hitting the crashed motorcycle, three additional cars collided.

According to InsideNova, a helicopter was flown in to take the motorcyclist to the Inove Fairfax Hosipital. He is said to have life-threatening injuries.

The driver of the Chrysler, Sandra T. Wilson, will be charged to following too closely.

This unfortunate accident follows another motorcycle accident that happened yesterday on I-95 in Fairfax County. The motorcyclist lost control of his bike, and was hit by a tractor trailer which did not stop at the accident. Sadly, the motorcyclist was killed.

According to Wavy, this morning around 8 a.m. a motorcycle and a SUV collided on Indian River Road in Virginia Beach. Southbound Indian River Road was closed from Kempsville Road until around 10 a.m.

PilotOnline reported that the SUV was attempting to take a left turn into a parking lot when the motorcycle struck it.

Sadly, the motorcyclist Alonzo James Zuke of Virginia Beach was killed.

2 People Hit in I-264 Portsmouth Accident; Samaritan Seriously Injured

A Toyota Rav4, driven by Nellya Vinarova, ended up in a median between the east and westbound lanes on Interstate 264 just before the Victory Boulevard exit. According to Wavy, a Good Samaritan, Clifford Hilborn of Chesapeake, stopped at the shoulder and attempted to flag down help from a tow truck.

As traffic began to come to a quick stop a Chevy pick-up truck was forced to slam on it's brakes, and ended up hitting the two pedestrians. Both Nellya Vinarova and Clifford Hilborn were seriously injured and taken to Sentara Norfolk General Hospital. According to WTKR, Clifford "Chip" Hilborn ended up losing his leg in the accident.

The DailyPress reports that the driver of the Chevy that hit them, Vincent Brown of Suffolk, lost control of his vehicle and drove into the median hitting the two pedestrians.

Charges are currently pending.

On Monday, April 29 around 8 p.m. two cars collided at a busy Virginia Beach intersection sending two people to the hospital. According to Wavy, the accident happened at the intersection of Princess Anne Road and Lynnhaven Parkway.

One of the individuals involved in the accident was pinned inside their vehicle.

The accident is still under investigation.

Texting and Driving is a Primary Offense in Virginia

Effective July 1, 2013 anyone caught texting-while-driving in Virginia will be fined $125 for a first offense and $250 for a repeat offense, reports the delmarvaNow.

The new law includes entering text into a phone to send a message or e-mail or to use a search engine. It does not however include scrolling through songs on iTunes or even playing games. GPS navigation and Siri are not prohibited either.

So how will this new law be enforced? Police officers will be able to pull a car over if they suspect the driver is texting. The officer will then ask to see the driver's cell phone to see if any text messages were sent within the last couple of minutes. If the driver refuses to give the police officer their cellphone a ticket will be issued which can be disputed in court.

Currently under Virginia law, texting while driving is a secondary offense. This means that law enforcement may not pull you over if they see you texting and driving, however they can charge you for texting while driving if they pull you over for a primary offense. There are several exceptions; bus drivers and drivers under 18 can be pulled over if caught texting and driving.

10 Things All Drivers Should Know About Motorcycles

Motorcycle riders are frequently the victims of careless and inattentive drivers of cars and trucks. Whether the carelessness is caused by a drunk driver, or the all too frequent indifference that motorists exhibit towards motorcyclists, the results of a collision with a motorcycle are all too often catastrophic or fatal.

The Motorcycle Safety Foundation (MSF) lists 10 important things drivers should keep in mind when sharing the road with motorcycles:

1. Over 50% of all motorcycle crashes involve another vehicle. Most of the time the driver of the 4-wheeled vehicle is at fault, not the motorcyclist.

2. Because motorcycles are much smaller than cars, trucks, and buses, they are easily hidden in car's blind spots. It is important for drivers to take an extra look for motorcycles before changing lanes and taking turns.

3. A motorcycle may actually be a lot closer than it appears. It is also difficult to judge a motorcycles speed, so it is important to keep in mind that they may catch up to you a lot faster than you realize.

4. Motorcyclists often slow down by downshifting or rolling of the throttle, so their brake light is never activated. Because there is no physical warning, you should allow a larger following distance.

5. Motorcyclists often adjust their lane position to be seen more easily, to minimize the effects of the wind, or avoid debris.

6. Motorcycle turn signals are not self-canceling, so some riders (especially beginners) may forget to turn them off.

7. Because of their size, motorcycles have much better maneuverability than cars, however drivers should not expect a motorcycles to always easily dodge out of the way.

8. The stopping distance for a motorcycle is nearly the same as a car. Be sure to leave enough following distance -especially in the rain or snow.

9. When you see a motorcycle on the road, see more than just the motorcycle. There is a person under that helmet who could be your friend, family, or relative.

10. If a driver were to crash into a motorcyclist, bicyclist, or pedestrian causing serious injury the driver would probably never forgive themselves.

Stanley Farms Sued by Group of Employees for Wages & Discrimination

Stanley Farms LLC, one of the biggest producers of Vidalia onions, is being sued by a group of employees. The lawsuit alleges that Stanley Farms paid foreign guest workers more than American workers. It also states that American workers ere being paid less than minimum wage.

According to SFGate, a federal lawsuit was filed last week by four American farm workers and 16 former co-workers against the company and its managers.

The American farm workers were hired to pull, clip, stem, and bucket the onions. The American workers were being paid .40 cents her 5-gallon bucket, which did not add up to the minimum wage of $7.25/hour. During this same period Stanley Farms paid foreign guest workers between $9.11 - $9.38 an hour.

Woman Dies on Birthday When Car Hits Police Vehicle Head-On

On Friday, April 19th a vehicle traveling down Tidewater Drive in Norfolk hit a police vehicle head-on killing one person and injuring others.

Karoline D. Johnson, who had just turned 21, was a passenger in her own vehicle that a friend was driving when the vehicle crossed the median and hit a police car head-on.

Sadly, Karoline Johnson was killed. The driver of the vehicle was taken to the hospital and is said to be in critical condition. The police officer was taken to the hospital with non life-threatening injuries.

Three Car Accident at Intersection of Cascades Pkwy in Potomac Falls

On Wednesday, April 17 an accident at the intersection of Cascades Parkway and Algonkian Parkway sent several people to the hospital with minor injuries, according to LeesburgToday.

Around 9:30 p.m. Madison Desimone made a left turn, from Algonkian Parkway, into the path of two vehicles traveling down Cascade Parkway. As Desimone made the left turn she was hit by a Grand Prix driven by Caroline Wilson. Desimone's car then hit John Huff's Dodge Ram.

Desimone and Wilson were taken to Inova Loudoun Hospital with minor injuries.

Madison Desimone was charged with failure to yield the right of way.

Mitsuwa Corp. to Pay Hispanic Workers $250,000 in National Origin Discrimination Lawsuit

A large Japanese Marketplace in Edgewater, N.J., Mitsuwa Corporation, settled a $250,000 national origin discrimination lawsuit with their Hispanic employees.

According to the Equal Employment Opportunity Commission (EEOC), since 2005 the company routinely paid Hispanic employees less than non-Hispanic employees that did the same work. The issue surfaced when one employee filed a claim for being underpaid, and after an investigation the EEOC discovered that there were a number of other Hispanic employees that had been underpaid as well.

In addition to the $250,000 settlement Mitsuwa is to give current Hispanic employees a pay increase equal to $30,000 per year for three years.

Mitsuwa is also required to report compensation practices and discrimination complaints to the EEOC, in addition to training managers and employees about anti-discrimination policies.

Wrong-Way Driver Causes Head-On Collision on I-64 in New Kent; 2 Killed

On Tuesday, April 17, 2013 around 10:30 p.m. a man driving the wrong-way down I-64 in New Kent crashed into another vehicle head-on.

According to the TimesDispatch, James E. Fred was driving east in the westbound lanes when he struck another vehicle being driven by John J. Kessler. Both men were killed.

$70,000 EEOC Settlement for Pregnancy & Disability Discrimination Lawsuit

Government contractor Engineering Documentation Systems, Inc (EDSI) has agreed to settle a lawsuit which involves retaliation, pregnancy, and disability discrimination. According to the EEOC, the company is to implement anti-discrimination measures and pay $70,000 to settle the lawsuit.

The lawsuit was filed when a pregnant technical assistant was subjected to discrimination and retaliation. After learning about the pregnancy a management official made derogatory remarks towards her and denied her request to be moved closer to the bathroom because of nausea and vomiting. She was then terminated during her leave of absence.

Her husband, who worked as an engineering technician, was fired a year later for reporting the events to the EEOC.

"Workplace retaliation, in particular, has become an epidemic, comprising 38% of all EEOC charges filed nationally in 2012 and making up a whopping 47% of all charges filed in the state of Nevada," said Amy Burkholder, local director for the EEOC's Las Vegas Local Office. "Workers have the right to report discrimination and participate in related investigations without reprisal."

Former Hooters Waitress Forced to Quit for Disability Files Lawsuit

Sandra Lupo filed a lawsuit against a Hooters restaurant in St. Peters, Missouri alleging she was forced to quit after having brain surgery.

According to UPI.com, Sandra Lupo underwent brain surgery in June that left her with short hair and a scar on her head. While she was recovering she was visited by her manager who told her that she would be able to return to work and that she would not be required to wear a wig.

However, when she returned to work in July the regional manager demanded that she wear a wig. Sandra attempted to wear the wig several times but stopped because it was uncomfortable and interfered with the healing of her scar.

That is when the restaurant began to cut her hours leaving her with no choice but to quit.

The lawsuit states that the Hooters violated Missouri's Human Rights Act by discriminating against someone with both an actual and perceived disability. It also states that the company violated the Missouri Merchandising Practices Act by regularly reducing an employees hours until they are forced to quit.

I-81 Wythe County Tractor-Trailer Accident Injuring 2 People

On April 15th, 2013 around 4 p.m. a tractor-trailer traveling northbound on Interstate-81 in Wythe County crossed the median and overturned onto a pickup truck.

According to the Roanoke Times, William Persinger of Covington was traveling southbound in his Chevrolet Silverado when the tractor-trailer landed on top of him. Both the driver of the tractor-trailer and the Silverado were taken to Wythe County Community Hospital with injuries.

The driver of the tractor-trailer has been charged with reckless driving, not wearing a seat belt, three counts of drug possession, and one count of drug paraphernalia possession.

Motorcyclist Charged in Accident on Va Route 262

A motorcyclist is being charged after failing to yield after causing a collision with another vehicle.

According to Newsleader, a Dodge Caliber was traveling on Va Route 262 when a motorcyclist attempted to turn onto Interstate-81, crossing in front of the Dodge Caliber.

The Dodge Caliber and motorcycle collided. The motorcyclist was thrown against the guardrail where he landed on his shoulder. The Dodge Caliber hit the guardrail and flipped onto its side.

The woman and her 2-year-old child driving in the Caliber were taken to the hospital with minor injuries. The motorcyclist, Michael Pearson of Maryland, was also taken to the hospital, but with serious injuries.

Michael Pearson is being charged iwth failure to yield right of way.

Four Car Richmond I-95 DUI Accident Leaves 6 People Injured

On Saturday, April 6 around 2:30 a.m. a four car crash with serious injuries occurred on I-95 in Richmond. According to WRIC, the accident happened in the southbound lanes at mile marker 71.

Virginia State Police say that Darrell Payne, Jr. drove his Dodge Neon into the back of a Hyundai Elantra. The impact caused the Hyundai to hit the jersey wall right before being hit by a Mercedes and Toyota.

Darrell Payne Jr. and his two passengers suffered serious but non life-threatening injuries. Occupants of the Hyundai and the driver of the Mercedes were reported to have minor injuries. The occupants in the Toyota were not injured.

14 Students Taken to Hospital After Dinwiddie School Bus Crash

A Dinwiddie County school bus on its way to Sutherland Elementary ran off the road and struck a tree this morning. According to NBC12, the bus was carrying 41 students ranging from 6 to 12-years-old.

Fourteen of those children were transported to the hospital with minor injuries.

The accident happened on the left side of River Road near Logan Knoll Lane. Teh bus driver, Linda C. Moss of Petersburg is being charged with failing to maintain proper control of the bus.

Man Killed in Fatal I-81 Car Accident in Augusta County; Others Injured

A fatal accident occurred around 11 p.m. on Thursday, April 4 near Weyers Cave on Interstate-81.

According to the Virginia State Police, a Dogde pickup truck traveling north on I-81 ran off the road and overturned in the median. The driver of the pickup truck, Samuel J. Russo of Harrisonburg then fled the scene on foot.

Moments after Russo's pickup truck crashed a Ford Expedition, driven by Daniel Manso Jr. of New York, swerved to avoid hitting the pickup truck. Daniel Manso Jr. then lost control of the vehicle as it spun sideways and was struck by a tractor-trailer.

Sadly, Daniel Manso Jr. died at the scene. His passenger was flown to UVA Hospital with life-threatening injuries.

The driver of the tractor-trailer suffered minor injuries and was taken to a local hospital.

Samuel J. Russo was arrested in Harrisonburg the next day and is being charged with reckless driving along with other charges that are currently pending.

Fatal Charter Bus Accident on Rt 58 in Southampton County

Around 7 a.m. this morning, a charter bus traveling from Chapel Hill, N.C. to Hampton, VA crashed on Route 58 in Southampton County near Capron. According to Wavy, the driver of the bus lost control, ran off the road, and overturned into a ditch.

Two of the passengers were ejected. Sadly, one of those passengers, 58-year-old Doval Emmanuel Watson, died at the scene. The other passenger, his wife Theresa, was flown to the hospital and is in critical condition.

The Watson's were chaperoning a group of high school students from East Chapel High School on a field trip to Hampton University for High School Day. No students were injured in the accident.

The driver of the bus, Larry Brocks of Raleigh, works for Horizon Coach Lines and is being charged with reckless driving.

According to a study published by the Federal Motor Carrier Safety Administration (FMCSA) in 2009, 63,000 buses are involved in traffic accidents each year resulting in:

14,000 non fatal injuries
325 fatal injuries and
375 fatalities

Head-On Collision on I-85 in Brunswick County; 5 People Killed

Rajendra Jailall and Seelal Rampersad of New York have been identified as the last two victims in the I-85 head-on collision.

The driver and one of the passengers in the Toyota Corolla have been identified as Davindra Jailall and Krishna Maniram of New York. The two other two passengers have not been positively identified.

This morning around 5:42 a.m. on I-85 in Brunswick County a pick-up truck traveling the wrong way collided with another vehicle. The accident was happened southbound at mile marker 26 near Alberta.

According to the TimesDispatch, State Police had already been notified that there was a vehicle traveling on the wrong side of the road, but did not make it to the 2006 Honda Ridgeline before it collided with a 2011 Toyota Corolla.

Sadly, the impact killed both drivers and three others in the Toyota Corolla. The driver of the Honda Ridgeline traveling the wrong way has been identified as 70-year old Walter Edward Skinner of Richmond.

Details as far as why Walter Edward Skinner was driving the wrong-way are still unknown.

Driver in Fatal Midlothian Car Accident Receives 15 Charges, Including Felony Homicide

Around 6:40 pm.m on Friday, March 29th, troopers attempted to pull over a vehicle for an equipment violation near Powhite Parkway right before the Midlothian Turnpike. According to WRIC, when the troopers motioned for the driver, Karon M. Porter, to pull over he begin to flee at a high rate of speed.

Troopers lost sight of Porter for a few moments before seeing him sideswipe two vehicles and strike a third at the intersection of Route 60 and Moorefield Park Drive. Porter then attempted to carjack a another driver before being arrested by the police.

Sadly the driver of the third vehicle that Porter crashed into, George M. Van Orden, suffered suffered serious injuries and passed away the next day. A passenger in the vehicle with Van Orden was also seriously injured.

Karon M. Porter is currently facing 15 charges. According to WRIC, the charges are: "felony and misdemeanor eluding police, obstruction of justice, attempted carjacking; two counts of maiming of another while driving under the influence, felony hit and run; two counts of misdemeanor hit and run; driving under the influence, refusal to submit to a blood or breath test, driving while suspended, disregarding a traffic light, defective equipment, and failure to wear his safety belt."

The National Safety Council has recognized April as the National Distracted Driving Awareness Month in an effort to get people to understand the dangers of using their cell phones while behind the wheel. The main goals are to get people to:

Virginia 95-Car Pileup on I-77 Carroll County; 3 Killed Others Injured

On Easter, Sunday March 31st a chain reaction of car accidents occurred on Interstate 77 involving 95 vehicles in 17 separate crashes. The pileup happened around 1:15 p.m. near the base of Fancy Gap Mountain in Carroll County which was covered in dense fog. The largest accident within the pileup included 8 vehicles where many of the vehicles caught fire.

According the Huffington Post, three people were killed and 25 were injured. The three victims have been identified as: William Sosebee of Allen, Ky., Kathern Worley of Iron Station, NC., and Andrew Katbi of Delphos, Oh.

"This mountain is notorious for fog banks. They have advance signs warning people. But the problem is, people are seeing well and suddenly they're in a fog bank," said Glen Sage of the American Red Cross office in the town of Galax.

School buses where brought in to take those stranded to shelters and hotels.

Doctor Wins Whistleblower Lawsuit Against Laguna Honda Hospital in San Francisco

Derek Kerr was a hospice physician at Laguna Honda Hospital in San Francisco for 21 years. Kerr and a colleague both lost there jobs in 2010 after filing a whistleblower complaint about the misuse of a patient gift fund.

According to the SFExaminer, the hospital started using donations meant for the patient gift fund to hire staff for a hospital-connected non-profit and for a capital project.

Kerr was fired one day after the city's Ethics Commission received the complaint.

The settlement included $750,000 in compensation, a plaque commemorating his service placed in the hospital, and training for the hospital's executive administrator on whistle-blowing and First Amendment rights.

Kerr says that his medical career is over and he wishes to dedicate his time advocating for other whistleblowers. Kerr says, "You can destroy someone's career and the City will protect you."

$2 Million Verdict for Police Chief Racial Discrimination Lawsuit; Medina, WA

Former Police Chief Jeffrey Chen filed a lawsuit against the city of Medina and it's city manager, Donna Hanson, for racial discrimination after being terminated. Jeffrey Chen, a Chinese-American, said that Donna Hanson would make racist comments towards him as well as deny him responsibilities that other city managers normally gave to those in his position.

Chen says that Donna Hanson tried to portray him as a corrupt officer in order to have in terminated, but her real motivation was racism.

An 11-day trial resulted in a $2 million dollar verdict for Chen. According to the Seattle Times, the verdict included compensation for punitive damages, back pay, future pay, and emotional harm.

According to the Equal Employment Opportunity Commission (EEOC) racial/color discrimination is illegal in all aspects of employment including: hiring, firing, pay, job assignments, promotions, layoff, training, benefits, and any other condition of employment. This also includes treating an employee unfavorably because his/her spouse or family members are associated with people of a certain race/color.

Racial slurs, offensive derogatory remarks about a person's race/color, and displaying racially-offensive symbols all fall under racial harassment. Man on Motorcycle Dies in Virginia Beach Holland Road Accident; SUV Driver Charged

On Friday, March 22, 2013 a motorcycle and an SUV were involved in an accident near the 2800 block of Holland Road around 4:40 p.m.

According to PilotOnline, Ralph J. Topland III, the motorcycle driver, was traveling north on Holland Road when he swiped the passenger side of a Cadillac Escalade which was traveling south.

The driver of the Cadillac, Demissew Gedamu, was attempting to make a left at the time, but the motorcycle had the right of way.

Sadly Ralph J. Topland III died in the hospital from his injuries.

Demissew Gedamu has been charged with failure to yield the right of way. The accident is still being reveiwed for additional charges.

Man Killed in Fatal Accident at Craft Machine Works in Hampton

Around 9 a.m. at Craft Machine Works in Hampton a man was killed in an industrial accident, according to Fox43TV. Police have not released a name, but say that the 54-year-old man was a resident of Newport News.

The man appeared to be working by himself and was later found dead. There were no witnesses.

Craft Machince Works is a custom manufacturing facility providing services to a variety of public and private companies.

The Occupational Health and Safety Administration (OSHA) is currently investigating the accident.

EEOC Settles Outback Steakhouse Disability Discrimination Suit for Worker with Brain Injury

OSI Restaurant Partners, LLC, is a subsidiary of Bloomin' Brands which operators over 1,400 restaurants including Outback Steakhouse, Carrabba's, Bonefish Grill has recently settled a disability discrimination lawsuit with the EEOC.

Server John Woods, who worked at the Phoenix Metrocenter location, alleged that he was terminated by new management because of his traumatic brain injury. The Equal Employment Opportunity Commission (EEOC) reported that Mr. Woods had worked successfully under prior management.

EEOC Phoenix District Director Rayford Irvin states, "Managers cannot fire employees because of their mistaken beliefs about what individuals with disabilities can accomplish." Disability discrimination violates the Americans with Disability Act (ADA).

Outback Steakhouse is to pay John Woods $65,000, revise its disability discrimination policies, train its Arizona managers about discrimination laws, and post information to employees about the ADA.

Former Public School Safety Chief Files Age Discrimination Lawsuit in Pittsburgh

Robert Fadzen was a Pittsburgh Public School District safety chief until he was let go to be replaced by a younger and healthier individual. For this reason Mr. Fadzen has filed a federal lawsuit against the district claiming that they violated the Age Discrimination in Employment Act.

Mr. Fadzen had worked for the district from 1994 until August of 2012, when he was fired because of an improper traffic stop. After filing an age and disability discrimination claim with the Equal Employment and Opportunity Commission (EEOC), an investigation into the improper traffic stop was prompted.

The investigation revealed that prior to the incident, Mr. Fadzen had been subjected to comments about his health, the medical devices prescribed to him, and his ability to perform his job.

According to the Post-Gazette, he is requesting a jury trial, reinstatement to his previous position or a similar position, compensation for lost wages, commissions and benefits.

Fatal Scooter Accident at London Bridge and Shipps Corner in Virginia Beach

According to WVEC, a fatal three-vehicle accident involving a scooter occurred around 11:30 a.m. this morning. The accident happened near the intersection of London Bridge and Shipps Corner close to Dam Neck. The driver of the scooter, Traci Lynne Fulgham, died at the scene.

According to the preliminary report, a Dodge Charger traveling down Drakesmile Road and a Kia traveling down Shipps Corner Road collided in the intersection. The Dodge Charger then spun out and hit the scooter, according to PilotOnline.

The accident is still under investigation.

On Monday, March 18 around 11:20 a.m. a woman traveling on Center Avenue attempt to make a left turn onto Jefferson Avenue when a pickup truck struck her.

The driver of the pickup truck, Hernan Conilla, was cited for not having an operator's license and for reckless driving.

According to the DailyPress, both drivers were transported to the hospital with non-life threatening injuries.

Distracted driving occurs when a driver engages in an activity which diverts their attention away from driving. Fatal Pedestrian Accident on Colonial Ave in Ghent Area of Norfolk

Saturday, March 16 around 8:30 p.m., a pedestrian was hit near the intersection of Colonial Avenue and Boissevain Ave in the Ghent area of Norfolk. According to WVEC, the victim was taken to the hospital where he passed away Sunday night.

PilotOnline recently announced that the pedestrian was 59-year-old Michael W. Slaughter.

The accident is still being investigated, however it has been determined that charges will be filed.

Ashburn Student Driver Car Accident Injures Three Children, 1 Seriously Injured

Thursday, March 14 around 7 p.m. in Loudoun County, a 15-year-old girl receiving driving lessons from a parent mistakenly accelerated, went over a curb, and onto a sidewalk were three young children were playing.

According to WJLA.com, all three children were hit by the vehicle.

The girls were only 7, 8, and 10. The 7-year-old girl was flown to Inova Fairfax Hospital with life-threatening injuries.

According to NBC12, the teen may be facing reckless driving charges.

Motorcyclist Killed in Fatal Portsmouth Accident at Port Center Pkwy and Edwards Street

This morning around 6:25 a.m. a motorcyclist attempting to make a left onto Edwards Street from Port Center Parkway in Portsmouth collided with a Chevrolet Silverado.

Sadly the motorcyclist, 24 year-old Joshua Carter of Chesapeake, died at the scene. The driver of the SUV suffered minor injuries. Both the motocyclist and the driver of the SUV were members of the United States Navy.

According to the PilotOnline, alcohol was not a factor in the crash and the accident is still under investigation. Information on charges has not been released.

Pedestrian Killed After Being Hit by SUV in Henrico Co.

According to NBC12, 23-year-old Philip C. Marshall was the pedestrian that collided with an SUV at the intersection of Hungary Road and Fairlake Lane yesterday. Sadly, he passed away from his injuries Monday afternoon.

Police do not think that speed was a factor, but they are still trying to find out if alcohol was involved. The driver of the SUV is expected to survive his injuries.

The accident is still under investigation and charges have yet to be filed.

Around 1 a.m. a pedestrian was hit by a SUV at the intersection of Hungary Road and Fairlake Lane. The driver of the SUV crashed into a fence immediately after hitting the pedestrian.

According to NBC12, the pedestrian was taken to the hospital with life-threatening injuries. The driver of the SUV was also taken to the hospital with, but with non-life threatening injuries.

The accident is still under investigation.

On Tuesday, March 5 a pedestrian attempting to cross the 2100 block of Lafayette Boulevard around 8 p.m. was struck by two cars, according to WVEC. When police arrived the man had already dies from his injuries. Both drivers remained at the scene, and it is unclear at this time whether charges will be filed.

Around 10 a.m. this morning, a bicyclist was taken to the hospital with serious injuries after being hit by a vehicle at the intersection of Ashburn Village Boulevard and Gala Circles.

According to Leesburg Today, witnesses and physical evidence left at the scene helped Loudon County Sheriff's Office track down the suspect who had fled the scene.

Shayne Miller-Westfield of Ashburn was arrested and charged with reckless driving and felony hit and run.

Fatal Virginia Beach Accident on Ansol Lane, Driver Charged with DUI & Manslaughter

On Saturday, March 2 around 5:30 p.m., a deadly accident occurred on Ansol Lane in Virginia Beach. According to Fox43, Michael McIntyre was traveling westbound down Ansol Lane when he crossed the street, ran off the road, and struck several trees.

One of his passengers was taken to the hospital with non-life threatening injuries. Sadly the second passenger, Robert Lancaster of Norfolk was killed.

Police say that Michael McIntyre was traveling at a high rate of speed as well as driving while under the influence of alcohol.

He is being charged with DUI, involuntary manslaughter, and driving with a suspended license.

Whistleblower Fired for Reporting Abuse Sues School and Roman Catholic Diocese of Sacramento

A football coach at St. Patrick-St. Vincent Catholic High School has filed a lawsuit against the school and the Roman Catholic Diocese of Sacramento for wrongful termination after reporting sexual hazing on his team.

According to News10, in December Chris Cerbone overheard that varsity players were hazing freshman players in the locker room by exposing their genitals to them. He then immediately reported this to Child Protective Services, a chaplain, and then the school principal. A little while after he was fired.

Cerbone's attorney says that this is a classic case of whistle blower retaliation. However, the Sacramento diocese spokesman says that factors other than his reporting the incident went into the consideration of his termination.

The lawsuit seeks lost wages, emotional distress damages and punitive damages, and attorneys fees for having suffered defamation, wrongful termination, and retaliation.

Hyundai Motor Co is being sued for failing to pay overtime to hourly workers as well as not providing them a true lunch break at a Philadelphia plant.

According to Bloomberg Hyundai Rotem, which is a manufacturer based in Seoul, would automatically deduct 30 minutes of paid time from each shift whether or not a lunch break was actually taken.

Hyundai Rotem also did not pay their employees for overtime worked.

The federal lawsuit accusing Hyundai Motor Co. of violating federal and state wage laws will represent employees who worked at the facility within the last three years.

EEOC Files Lawsuit Against Prestige Transportation Service for Hiring Discrimination

The U.S. Equal Employment Opportunity Commission (EEOC) has filed a lawsuit against Prestige Transportation Service, LLC in Miami accusing them of hiring discrimination practices. According to the lawsuit the company refused to hire black applicants stating, "black people were trouble and would sue the company."

The lawsuit states that in addition to refusing to hire black applicants, they discriminated against a black employee and retaliated against three employees for refusing their discriminatory practices and filing charges with the EEOC.

At one time the company singled out a black employee forcing her to leave early on a regular basis, while allows Hispanic employees to work full time. They also retaliated against 3 employees by firing for voicing their objections to such practices.

The EEOC says that Prestige Transportation Services, LLC regularly told human resources that it would be a "waste of paper" to give an application to a black person.

Dale Boulevard Hit and Run Car Accident Sends 4 People to the Hospital

On Wednesday, February 21 around 9 p.m., three vehicles were at the intersection of Dale Boulevard and Cloverdale Road when a Toyota Corolla slammed into the back of one of the vehicles causing a chain reaction accident.

According to PotomacLocal, the passenger of the Toyota Corolla got out of the vehicle to check on the other people involved. The Driver of the Toyota Corolla then fled the scene.

A few moments later a Dodge minivan approached the intersection but did not see the pedestrians in the road from the accident and was forced to swerve into the turning lane to avoid them. Unfortunately two people standing in the turning lane where hit, along with two others standing on the road.

Four people were taken to the hospital with injuries.

Police believe that the driver of the Toyota Corolla may have been drinking and driving, however the driver has yet to be found.

On Monday, February 4, 2013 around 2 p.m. a woman driving a Toyota Tacoma north on U.S. 1 at Rippon Boulevard ran a read light and crashed into a Toyota Scion.

According to InsideNOVA, Earnestine Larry who was a passenger in the Scion that was hit, was not taken to the hospital. However, days later she was taken to Fairfax Hospital and died on February 9, 2013 from head injuries sustained in the crash.

The driver of the Tacoma, Ruth Del Carmen Zelaya Campos, has been charged with reckless driving.

Nashville Hotel Workers file Lawsuit; Underpaid and Denied Overtime

Housekeepers working for two hotels owned by a well known real estate investor filed a federal lawsuit alleging they have been paid below minimum wage and denied overtime for years. The Best Western Music Row and the Comfort Inn Downtown are both owned by Rajesh Aggarwal who has over the years built an impressive real estate portfolio.

According to the Tennessean, housekeepers of both hotels have claimed that they have been paid as little as $3.50 an hour working up to 70 hours a week without breaks. Henry Hernandez, one of the plaintiffs, stated the management never did anything to stop it.

A local labor rights group, Advocates at Workers Dignity, stated that many of the housekeepers hotels employ are single Hispanic women. The lawsuits state that they were often paid a flat rate of $650 - $676 every fifteen days and were given only one day off per week. Fourteen hour days were very typical of the housekeepers.

Housekeepers who worked for either of the two hotels within the past 3 years are eligible to join the lawsuit. The lawsuit was filed by Attorney Karla Campbell.

Diffuse Axonal Injury

Diffuse axonal injury, also known as DAI, is a closed head injury that occurs from the violent back and forth movement of the brain within the skull from acceleration and deceleration. DAI affects the nerve fibers which are composed of the neuron body and an axon. When violent acceleration and deceleration occur, nerves can be stretched or the neuron body can be severed from the axon causing the nerve cells to die. When the nerve cells begin to die the brain begins to swell. This swelling can cause pressure in the brain decreasing blood flow causing other problems.

CausesDiffuse axonal injury is one of the most common and severe traumatic brain injuries. DAI is common in vehicle related accidents because of the force and violent shaking of the brain that occurs. In children, the occurrence of such violent shaking can result in Shaken Baby Syndrome. Any event in which a sudden acceleration and deceleration occurs can injure these nerve fibers causing DAI.
SymptomsWhile most other traumatic brain injuries affect a specific area of the brain, DAI can be widespread. This is one of the reasons this type of traumatic brain injury can be so devastating. Diffuse axonal injury usually affects consciousness and can be classified from mild to severe. As a result the injured may enter a coma, or in severe cases a permanent neurological disability can occur, such as a persistent vegetative state.
Diagnosis

Depending on the severity of your injury, your symptoms, and other factors, a medical professional may administer some tests.

Motorcyclist Injured on Plantation Road in Hollins, VA

A motorcyclist was taken to the Roanoke Memorial Hospital with non-life-threatening injuries after colliding with another vehicle on Saturday, February 16th.

According to Roanoke.com, Mr. Eric Ellen was traveling southeast on his motorcycle when a Ford Focus turned into its path. The accident occurred at the intersection of Plantation and Dexter roads, shutting down a portion of Plantation Road for a little over an hour.

The driver of the Ford Focus, Julie Morris, has been charged with failure to yield the right of way.

Teen Dies in Fatal Car Accident on Shore Drive in Virginia Beach

According to WVEC, a fatal car accident occurred on Shore Drive in Virginia Beach. Stephen Clark Jr. was driving the Honda S2000 at a high rate of speed when he lost control, went off the road, and struck several trees. 18-year-old Gregory Welch was killed.

On Friday, February 8th 68-year-old Robert Richards of Roanoke was hit by a pickup truck driver on Dale Avenue while riding his moped down the street. According to WDBJ7, Mr. Richards was taken to Carilion Roanoke Memorial Hospital with serious injuries. Unfortunately on Saturday he passed away from the injuries he sustained.

The driver of the pickup truck, Jonathan Brookman of Radford has been charged with following too closely.

Yesterday a superintendent from SKANSKA, a Virgnia Beach construction company, was taken to the hospital with unknown injuries, according to WAVY10. The accident happened around 6 p.m. at Norfolk Naval Shipyard. A concrete bucket fell on the worker after a floating crane malfunctioned and gave way.

The worker was taken to Sentara Norfolk General Hospital and was said to be alert at the time.

Suffolk Man Charged for Hit and Run Accident Involving Bicyclist on East Washington

Abraham Mitchell, an 82-year-old Suffolk man, has been charged with hit-and-run after hitting a man on a bicycle on East Washington Street.

According to PilotOnline, the bicyclist Keith Henderson was taken to Sentara General Hospital with injuries to his leg, hip, and back.

Henderson says that Mitchell got out of his car and talked to a woman who had stopped to help him. Then Mitchell got back in his car and left. Later when Mitchell was stopped by an officer, he told the officer that the woman said he could leave.

Study Shows High Rate of Vision Problems After a Traumatic Brain Injury

According to ScienceDaily a recent study titled "Mechanisms of TBI and Visual Consequences in Military and Veteran Populations," reports high occurrences of vision problems in patients with traumatic brain injuries.

The study included Iraq and Afghanistan War veterans who had received blast-related traumatic brain injuries. This type of unique injury involves the distance between an explosion and the solider, causing direct head trauma in one third of blasted-related TBIs.

These results were compared to patients with non-blast related traumatic brain injuries, mostly those received in vehicle related accidents.

Here are the results:

More than 65% of blast-related and non-blast-related patients reported vision problems.
About 50% of the patients reported problems with reading.

67% of blast-related patients complained about light sensitivity,
33% of non-blast-related patients reported the same problem

85% of non-blast-related patients reported eye movement problems,
While 58% of blast-related patients reported the same problem

Woman Files Discrimination & Retaliation Lawsuit against two Oregon State Agencies

A $6.7 million dollar lawsuit was filed against the Department of Human Services and the Oregon Health Authority accusing the state agencies of discrimination and retaliation after a former employee pointed out financial irregularities.

Victorina Mata, a former communications officer, is suing the two state agencies alleging that she was let go after pointing out financial irregularities as well as discriminated against as a Native American, reports StatesmanJournal.

Victorina Mata had worked for the Department of Human Services and the Office of Healthy Kids in Oregon since 2009. While working there she expressed concerns about the state's overestimation of the number of children without health insurance claiming that the state was "trying to beef up the number." This was only one example of financial practices she began to question.

After a state audit in 2011, the Oregon Healthy Kids program had to repay $4.5 million dollars of a federal bonus because of the inflated enrollment numbers.

During this time she was excluded from meetings and was denied promotions given to other non-minority employees. By the next year she had been laid off because of state budget cuts.

According to the lawsuit, these practices violated the state's whistle blowing laws as well as federal race and national origin discrimination laws.

The lawsuit also lists other management figures from the Department of Human Services and Oregon Health Authority claiming that these employees violated her constitutional rights to due process, equal protection and, freedom of speech.

Victorina Mata stated that the $6.7 million was being sought for retaliation for whistle blowing, discrimination and violation of her constitutional rights.

Two drivers and a child were taken to the hospital after a head-on collision on Warwick Boulevard in Newport News. According to the DailyPress, the car accident happened just before 8 a.m. when a Chevrolet first sideswiped a van before it crossed into oncoming traffic and hitting a BMW.

The injured persons were taken to the hospital with non-life threatening injuries.

The driver of the Chevrolet, Collin Striggles of Newport News, apparently fell asleep at the wheel. He is being charged with reckless driving.

Man in Wheelchair hit by a car and killed in Norfolk, Tidewater Drive

A pedestrian in a wheelchair was struck by a car while attempting to cross Tidewater Drive in Norfolk around 6:45 p.m. He was within the crosswalk.

According to WVEC, the victim was 67-year-old James Gregory Camp of Norfolk. Tragically Mr. Camp died from his injuries.

The accident is still under investigation, but we do know that alcohol was not a factor in the accident. Charges are to be determined by the Commonwealth's Attorney's office.

Woman walking on side of I-64 Norfolk struck and killed; driver charged

On Sunday, January 20, 2013 a woman walking down the side of the road on I-64 was struck by a vehicle and later died from her injuries.

According to WAVY, Charisse Turner pulled over to the side of the road near Northampton Blvd around 1:30 p.m. Sunday because of a flat tire. Soon after another driver pulled over in front of her car to offer assistance. As Charisse returned to her car to get her purse another car ran off of the road, hit her, and then swiped her car.

Charisse Turner was taken to Sentara Norfolk General Hospital with life-threatening injuries. Sadly she later died from her injuries.

The driver of the vehicle that hit her, Jonathan Hueneman, has been charged with reckless driving.

Unpaid Overtime Lawsuit Against New Orleans Police Department

Former New Orleans Police Department (NOPD) officer Chad Perez says that he was forced to resign because of the retaliatory actions taken against him after he filed a formal complaint for not receiving adequate overtime pay. According to nola.com, he filed a class-action lawsuit in federal court seeking damages from the city along with a request to create a policy which forces NOPD to accurately keep track of overtime hours.

Chad Perez was a full-time employee and worked 42.5 hours a week. As a detective in the 1st District a lot of his time was spent following leads and investigating witnesses from criminal trials leaving administrative tasks, such as filling out reports, outside of work hours.

The current departmental policy states that when an employee works unscheduled hours, they are to receive equal time off within that pay period. If they cannot take the time off, they are to get time-and-a-half for overtime. Despite this policy, the Fair Labor Standards Act (FLSA), states that police employees that get compensation for hours worked off the clock are supposed to get time-and-a-half.

In 2011, a department memo went out that told supervisors they could not pay overtime to investigators who did clerical work, such as writing reports or answering emails, outside of their regular working hours.

Perez then advised the 1st District that these practices violated FLSA. After nothing was done he filed a formal complaint with their Public Integrity and the Department of Labor. When the commander received notification of the complaint he reported it Perez's Lieutenant who then confronted him. Perez says that his complaint was supposed to be confidential and that these actions violated NOPD's policies.

Within a couple of days of the complaint, Perez was disciplined for leaving his desk for three minutes. He says that a sergeant reported him for leaving his desk, not devoting his work time to his duty, and left the city while on the clock. Perez says that this same sergeant gave home permission to leave.

The incident was investigated and it was determined that Perez did not do anything wrong. However, when it came time from officer promotions a captain overturned one of the charges which made him ineligible for a promotion.

In addition, because the captain overturned one of the charges, Perez received a letter of reprimand for the violation. Although he received this letter of reprimand, this did not disqualify him from the next round of promotions. Chinese drywall settlement between Virginia Beach based builder and insurance companies

According to the Virginian-Pilot, a settlement between a builder and two insurance companies recently settled a federal lawsuit involving Chinese drywall. The lawsuit was settled with Hanover Insurance Company and Citizens Insurance.

Dragas Management Corporation subcontracted drywall work to a Norfolk based company, Porter-Blaine Corporation, who purchased defective drywall from the Chinese company Taishan Gypsum. Homes built between 2003 and 2006 at The Hampshires at Greenbrier in Chesapeake, and at Cromwell Park at Salem in Virginia Beach were affected.

The defective drywall, also known as wallboard, gypsum board, or plasterboard, arrived at about 2 dozen ports around the country with 7 of them in Florida, but including New York, Texas, New Orleans, and California. During the housing boom after Hurricane Katrina, among other storms, from 2004 through 2006, the strain on the supply of domestic drywall required many builders to resort to international suppliers to fill the demand.

Many imported drywall from a German-based company, Knauf, with subsidiaries in China (such as Knauf Tianjin). Reports are showing that millions of pounds of Chinese drywall entered the US during this time frame and that is was used across the country in thousands of homes, condos, and office buildings. Most foreign manufacturers stopped shipping drywall to the US in 2007, after the building boom was over.

Chinese drywall is said to emit sulfurous gases that can corrode metals, such as silver and copper, in homes. Residents of these homes have also reported respiratory problems, along with eye and skin irritations. The Federal product safety regulators have suggested that all contaminated drywall be removed from the houses it is found in.

Passenger Sues Amtrack Alleging Racial Discrimination

Mertis McMillan is suing Amtrack alleging that the conductor made her give up the seat she was in to accommodate a white couple.

According to Amtrack, the conductor, Donald Prince noticed on his electronic ticketing device that a couple would be getting on the train at a later stop. So they could sit together, Prince says he put down the tray tables for a set of seats. Later Prince noticed McMillan and a white woman sitting in the seats and asked them both to move.

However, Mertis McMillan's version of the story is different. She says that there was nothing on the seat that indicated it was reserved when she got onto the train in Richmond. The lawsuit also says that the conductor never asked the white woman sitting next to McMillan to move and that his orders were only directed towards her. McMillan also says that after the incident three passengers approached her to offer their support and contact information, according to the Virginian-Pilot.

The lawsuit was filed in federal court against Amtrack and the conductor Donald Prince, but does not specify the amount of compensatory or punitive damages she is seeking.

Christopher Colt North, the attorney handling the case, says that Amtrack denies doing anything wrong. Amtrack also offered McMillan a $131 Transportation Certification for future travel.

Woman in Wheelchair Fatally Struck by Car in Virginia Beach Accident

A woman was tragically killed on Christmas Eve when the driver of a SUV lost control of their vehicle in a parking lot and hit an elderly couple. The accident occurred in the Providence Square Shopping Center in Virginia Beach.

According to WVEC, the driver of the Jeep Cherokee was backing out of a parking space when his foot became entangled in the accelerator hurling the car forward.

Dalisay Fransico was in a wheelchair assisted by her husband, when the SUV hit them. They were both taken to the hospital where Dalisay Fransico later passed away. Her husband was treated and released.

Charges are currently pending against the driver.

Study Suggests Men More Likely to Die in a Vehicle-Pedestrian Accident

According to a study published in the Injury Prevention journal, each year pedestrian accidents account for one third of the 1.2 million traffic related deaths worldwide. Among these accidents, men are 2.3 more times liked to be killed.

Recently researchers have come up with a combination of three factors that contribute to these statistics:

distanced walked per person per year,
number of accidents per distance walked,
and number of deaths per accident

According to an article in the New York Times blog, the National Highway Safety Administration (NHSTA), reported for 2010:

4,280 pedestrians were killed in traffic related accidents
69% (2,946) of those killed were men.

Possible reasons considered by the lead researcher, Mr. Motao Zhu of West Virginia University, include:

men may be more likely to cross roads with higher speed limits
men may be more likely to cross roads while impaired by alcohol or drugs

Dillard's class-action lawsuit over sick leave settles at $2 million

Dillard's Inc. has settled a lawsuit which accused the department store chain of violating the Americans with Disabilities Act. According to the LATimes.com, the retailer implemented a nationwide policy which required those asking for sick leave to disclose private medical conditions.

The investigation began when a Southern California branch fired an employee in 2006 for refusing to disclose her exact medical conditions to a manager that would not accept her doctor's note.

The Equal Employment Opportunity Commission (EEOC), alleged that the nationwide policy Dillard's set in place in 2005 required anyone asking for sick leave to reveal what condition they were being treated for.

The settlement included $2 million to compensate the workers that were affected as well as an agreement to hire a consultant to revise their employment policies.

Children may be More Vulnerable to the Effects of a Mild Traumatic Brain Injury

According to a study published by The Journal of Neuroscience, a child's developing brain may be more vulnerable to the effects of a mild traumatic brain injury (TBI) compared to adults. The study shows that when a child sustains a mild TBI, changes in the brain continue long after the symptoms of the injury are gone. The study suggest that concussions alter the brain's white matter, which are the long fibers that carry information to different parts of the brain.

Researchers at the Mind Research Network and the University of New Mexico in Albuquerque focused their study on older children, between the ages of 10-17, with mild traumatic brain injuries. Their results concluded that the structural changes in the children's white matter two weeks after the injury, were still apparent more than three months later. This was true even after the symptoms from the brain injury had disappeared.

"These findings may have important implications about when it is truly safe for a child to resume physical activities that may produce a second concussion, potentially further injuring an already vulnerable brain," says Andrew Mayer, PhD, one of the researchers that conducted the study.

This study is significant because these results are very different from the structural changes of the brain in adults who had sustain mild traumatic brain injuries. Researchers say that this suggests the developmental differences in a child's brain may make them more susceptible to injury.

Virginia Beach Pedestrian Accident Involving Tallwood High School Student

Around 6:50 a.m., a Tallwood High School student attempting to cross the road was hit by a pick up truck, according to WVEC. The student was in the crosswalk and crossing the street minutes before the school zone lights were activated, reducing the speed limit from 45 MPH to 25 MPH.

The driver of the pickup truck did have a green light.

The 16 year old student was taken to Sentara Norfolk General Hospital, with non-life threatening injuries.

Bicycle, Motorcycle, and Truck Accident Deaths Increase Reports the NHTSA

According to the National Highway Traffic Safety Administration's (NHTSA) analysis of 2011 traffic deaths, bicycle and large truck related car accidents sharply increased. Motorcycle accidents also increased.

Bicycle accident deaths increased 8.7%
Deaths of occupants of large trucks increased 20%
Motorcycle accident deaths increased by 2.1%

However, overall auto accident deaths dropped to 1.9 percent to 32,367. The decrease occurred as the number of miles driven by motorists decreased by 1.2%, according to the Associated Press. In fact, 2011 experienced the lowest fatality rate ever recorded with 1.10 deaths per 100 million vehicle miles traveled.

This increase in bicycle deaths likely reflects the increase in people riding bicycles to work and for pleasure, according to Johnathan Adkins the deputy executive director of the Governors Highway Safety Association.

The increase of tractor trailer deaths is not exactly known, but may be because of the number of trucks back on the road as the economy bounces back.

Despite the overall decrease in auto related deaths in 2011, Jackie Gillan the president of Advocates for Highway and Auto Safety, says preliminary car accident data for 2012 shows an increase in vehicle related deaths and injuries.

Newport News Woman Dies in Fatal Accident on Warwick Blvd

On Sunday, December 9, 2012 Lori Norton of Newport News attempted to take a left turn onto Turlington Road from Warwick Blvd when a Chrysler Pacifica struck her car. According to Wavy, the Chrysler hit her Malibu on the front passenger side.

Lori Norton and the two people in the Chrysler were take to a local hospital. Sadly, Lori Norton died. The man and woman in the other vehicle were treated and released.

Although the crash is still under investigation, charges are pending against the driver or the Chrysler.

NYPD Officer's Workplace Retaliation and Harassment Lawsuit Reinstated

Officer Craig Matthews' workplace retaliation and harassment lawsuit, which was previously dismissed, was reinstated by the United States District Court of Appeals for the Second Circuit, according to the Wall Street Journal. Officer Matthews, a 14 year veteran, claims that he was subjected to retaliation and harassment after reporting a quota system being used within his precinct, something that is illegal in New York.

According to Matthews, his superiors required a monthly minimum number of arrests, summonses, and stop-and-frisks for each officer. If an officer did not meet a quota, they would receive undesirable assignments, lose overtime, were denied leave, and would receive poor evaluations.

The lawsuit also stated that this quota system often turned officers against each other. Those officers who complied with the quota system regularly had their lockers dislodged or plastered shut.

Officer Matthews claims to have reported the quota system to superiors on four different occasions. As a result he received assignments that were usually assigned to rookies, denied overtime and leave, and was separated from his career-long partner.

The case will be reopened in Manhattan federal court.

Tidewater Drive Car Accident Head-On Collision Injures 4

Around 7 P.M. on Thursday, December 6 on Tidewater Drive in Norfolk, an accident with non-life threatening injures was reported, according to WVEC. A vehicle crossed the median and hit another vehicle head-on.

Four people were taken to the hospital with injuries.

Chesapeake Car Accident Seriously injures 1 in Head-on Collision

A 22-year-old-man was transported to Sentara Norfolk General Hospital after sustaining serious injuries in a head-on collision. The other driver, a 65-year-old man, was not injured.

According to WTKR, the accident happened around 8 a.m. on Head of River Road in Chesapeake.

The accident involved a Ford Escort driven by the 22-year-old, and a Ford F-450 driven by the 65-year-old.

The accident is still under investigation and no further information is available at this time.

$10 million lawsuit filed against Drunk Driver who killed CNU Students

The families of Kimberley Brin and Sierra Smith have filed separate wrongful death lawsuits of $5 million against Jesse Evans Jr., according to the DailyPress.

Last year, Kimberley Brin, Sierra Smith, Laval Noel, and Deno Rich were traveling down I-64, when a SUV going the wrong way collided with them. Sierra Smith was killed at the scene, and Kimberley Brin died a day later. Both girls attended Christopher Newport University.

Laval Noel, the driver of the vehicle the girls were in, suffered injuries to both knees and walks with crutches. Noel is suing Evens for $700,000 to recover money for current and future medical expenses. Deno Rich, the front seat passenger, is suing for $1 million due to serious and permanent injuries.

Jesse Evans Jr. had a blood-alcohol level of 0.21, almost 3 times the Virginia limit of 0.08, the morning of the crash. The criminal trial for Evans is still in progress.

Bicyclist hit on Virginia Beach Blvd in Coma; Drunk Driver Gets DUI

On September 14, 2012, Willie Thigpen was riding his bicycle along Virginia Beach Boulevard when he was struck by a car. The driver, Nathan Casebolt, drove off after hitting Thigpen. Police later caught Casebolt after finding his license plate at the scene.

Today Willie Thigpen is in a coma and faces paralysis if he wakes up, according to HamptonRoads.com.

Nathan Casebolt has been charged with driving under the influence, driving without a license, and will receive a year in jail. He is still awaiting trial on a felony hit and run charge.

Racial Discrimination Lawsuit Settled with Panera Franchisee Covelli

Earlier this year Covelli Enterprises, a major Panera Bread franchisee, was sued for allegedly denying African American workers promotions. According to the Huffington Post, the class-action lawsuit was settled and could include 200 to 300 current and former employees.

The racial discrimination lawsuit was filed after an employee, Guy Vines, was denied a promotion stating that Sam Covelli didn't want black people in public view. Sam Covelli is the owner of Covelli Enterprises and has Panera Bread stores in Pennsylvania, Ohio, Florida, Kentucky, and West Virginia.

The settlement states that any African American who sought after a promotion between January 11, 2008 and January 11, 2012 may be eligible for payment for lost opportunities. These payments include 70 cents for every hour worked in excess of one year. The disbursement is said to be close to what these employees would have received had they gotten a promotion.

Virginia Considering A Proposal to Toughen Texting While Driving Laws

The Virginia State Crime Commission is considering a proposal to toughen the Commonwealth's laws on texting and driving after a Judge in Fairfax didn't convict a driver who was believed to be texting during the time of a fatal accident, according to the DailyPress.

Several options suggested by the State Crime Commission include:

that texting while driving is not excluded from being considered reckless driving,
a heftier penalty for traffic violations that were committed while texting,
or classifying texting while driving as reckless driving.

According to the Virginia Supreme Court, "reckless" is defined as "a disregard by the driver of a motor vehicle for the consequences of his act and in indifference to the safety of life, limb, and property."

Currently under Virginia law, texting while driving is a secondary offense. This means that police may not pull you over if they see you texting and driving, however they can charge you for texting while driving if they pull you over for a "primary" offense.

Virginia deems it unlawful for any person operating a moving vehicle to use any handheld personal communication device to:

to manually enter letters or text in the device to communicate with someone else
read email or text message sent or stored within the device

Exceptions include:

the operator of an emergency vehicle
an driver who is lawfully parked or stopped
the use of a GPS
anyone using the device to report an emergency

Spark's Steak House in New York recently settled a $600,000 lawsuit after the Equal Employment Opportunity Commission (EEOC) determined that the restaurant failed to stop a manager's abuse of 22 male waiters over an eight year time period.

According to the Washington Post, the EEOC accused the manager of groping the buttocks of male waiters, making inappropriate sexual comments, and attempting to touch their genitals.

It was discovered that harassment continued even after some of the victims told other managers what was going on. The restaurant would respond by retaliating against the victims giving them larger work loads or even suspend them.

According to the EEOC, unwelcome sexual advances, requests for sexual favors, or any other verbal or physical harassment constitutes harassment. Harassment is illegal when it is so frequent or severe to the point that it creates a hostile or offensive work environment.

$7.7 Million Discrimination Lawsuit won Against "Price is Right" TV Show

A former The Price is Right model recently won a $7.7 million discrimination lawsuit against the game show. Brandi Cochran worked for the show from 2002 until early 2009, according to Reuters.

The former model claimed that the producers of the show started to treat her poorly after she told them that she was expecting twins. She also said that the producers would make remarks about her eating habits and weight, and removed her from the website.

In February of 2009 her son was stillborn and her daughter was born prematurely a month later. When she tried to return to the show in February of 2010.

Brandi Cochran was awarded $775,000 in compensatory damages and $7.7 million in punitive damages.

Former LSU Tennis Coach Files Racial Discrimination Lawsuit Against the University

Louisiana State University is being sued by its former women's tennis coach, Tony Minnis, for racial discrimination. Tony Minnis claims that the salaries of white coaches were up to $30,000 more than his, according to NOLA.com. He also alleges that he was subject to unjust evaluations, false letters of reprimand, unfound write-ups, and race based discrimination while working at LSU.

The former LSU tennis coach was fired in June after qualifying for the NCAA tournament for the 15th time. Julia Sell, the replacement coach, was hired at a base salary of $110,000, while Tony Minnis earned $85,000. Tony Minnis was with LSU for 20 years, and was the most decorated coach in Louisiana State's program history.

One person was killed this morning after a head-on collision that occurred on Whaleyville Blvd Route 13. According to the PilotOnline, the accident was between a pickup truck and a passenger vehicle.

On Wednesday, November 15, 2012 an accident involving an elementary school bus in Northampton County sent 8 children to the hospital. According to WVEC, the accident happened around 1:30 p.m. pm Seaside Road, north of Cheriton.

The driver of the school bus hit a ditch and over corrected causing the bus to flip over on its side. The bus driver was charged with failing to drive within the confines of the roadway.

Lifeguard Suing Virginia Beach Lifesaving Service for Gender Discrimination

Robin Lang worked for the Virginia Beach Lifesaving Service since June 2005. During this time she was promoted to chief and had won several awards, including a national award.

However, when Robin Lang went to apply for the position of sergeant she was denied. She applied for the position four times, but each time it was given to a male lifeguard with less experience she had. She was also required to perform sergeant duties, but at lower pay.

The lawsuit also claims that the Virginia Beach Lifesaving Service retaliated against her by firing her after she complained to the Equal Employment Opportunity Commission (EEOC).

Virginia Medical Facilities Among those that Received Steroids with Fungal Meningitis

Over 100 hospitals and outpatient clinics in Virginia used drugs produced by the New England Compounding Center (NECC), the Massachusetts pharmacy accused of being the source of the fungal meningitis outbreak, according to Roanoke.com. To date, the Centers for Disease Control and Prevention (CDC) is aware of 29 deaths and 377 cases in 19 states.

More than 3000 facilities across the country received shipments of drugs from the specialty pharmacy. The U.S. Food and Drug Administration (FDA) recently released a list of these facilities that received a shipment since May 21. They have also advised these facilities to contact patients who received any injectable medication from those facilities.

All drugs produced by the New England Compounding Center have been recalled. However, currently the meningitis outbreak has only been linked to three batches of steroid injections. Although the investigation of the NECC is still underway, a number of sanitation issues have been discovered which could potentially mean other products could be contaminated.
